The Role:
The Commercial Manager reports to the Lead Commercial Manager/ Head of Project Services functionally and to the Portfolio Manager on a daily basis. The Commercial Manager provides complete contract management services for the client on designated projects, according to the needs and the stage of a specific project. Working closely with all functions, they will primarily support commercial aspects of live contracts, minimising risks and maximising opportunities, whilst ensuring accuracy of forecasts in line with company policies and procedures.

Main Responsibilities:

Nominated Commercial Manager for live projects.

Management and oversight of the entire contract management process serving as the key point of contact for customers and subcontractors for any contractual matters, both in the pre-contract and contract execution phases.
Use of the necessary resources, skills and processes for contract negotiations, change management, processing of claims, processing of EWN/ CEs & dispute resolution with the client and reporting thereof.
Maintain full EWN/ CE records - both on the company's project DC system(s) and, if prescribed under the contract, on the client's change management systems
Maintain accurate and up to date Change Registers and report status thereof within standard company, monthly Project Dashboard; work with Portfolio Manager and Cost Engineer to ensure appropriate cost and value recognition (forecast and actuals); provide "3 Point Assessments" (Best Case, Most Likely and Worst Case) of all pending changes and support the Portfolio Manager with assessing the key risks and opportunities on the project.
Minimising risks and maximising opportunities during contract execution phase; Management and reporting of a suite of Key Performance Indicators that measures the key parameters of contract performance.
Manage and implement 'flow down' contracts with subcontract supply partners, ensuring the same terms and conditions from clients are flowed down to subcontractors as to ensure no/ minimal risk to the business.
Manage the payment application process and implement and monitor a robust and regularly maintained EWN/ CE process with the subcontractor.
Ensure cash positive (or as a minimum cash neutral) contracts, working with the PM and Project Controls team to report, monitor cash inflow and cash outflow and ensure minimal work in progress and outstanding client invoices.

Additional Responsibilities:
Support wider commercial team, recognising fluid demand for commercial services on other project portfolios and tendering department
Supporting to other Portfolio Managers/ Commercial Managers on other live projects (e.g. during leave absence, sickness or high volume activity)
Working with assigned bid teams and the company's Legal Department to analyse the contractual terms & conditions proposed by Customers, assuring accuracy and appropriateness of contract texts and schedules, ensuring that proposals are aligned to company's policies and procedures.
Support and provide input on continuous improvement of standard commercial and contracts management processes and procedures and engage on any training/ audit initiatives and internal commercial forums.

Essential Skills / Qualifications:
Degree qualified, with extensive commercial experience working for EPC organisations within a highly regulated industry
Extensive experience developing complex tenders within multi-disciplined bid teams
Specific experience in dealing with contractual matters and interfacing with legal departments
Experience with most common forms of contract (NEC & FIDIC) within the power construction industry and major projects and programme environment; with particular knowledge of UK Law and its impact upon the contract and commercial function is essential.
Good working knowledge of typical IT project tools (Microsoft Office, Primavera etc)
Flexible on working location; primary base Risley but with frequent visits to Midlands and client sites.
Dynamism, aptitude for problem solving and team work, practicality, reliability, flexibility, and results oriented; Good communication skills and interpersonal relations at all levels
Strong negotiating skills with the ability to secure the required out

Desirable Skills / Qualifications:
Professional memberships an advantageous but not essential
