Job Purpose:

Sr. Engineer, Construction Contract is required to provide professional support to Engineering team in contractual and commercial aspects related to contract strategies, procurement strategies pre/ post-contract management.

During the project, the job holder handles and/or provides high quality advice on any contractual and commercial issues in order to ensure that the Company’s interest is best protected. By coordinating with Legal and Procurement Departments, the job holder examines, evaluates, and provides recommendation to manager or relevant Company’s staff on the consideration of any claims by the contractors for time extension, payment for extra work, etc.

The job holder also sets up of pre-contract strategy and prepares and/or reviews contract documents. He/She liaises with other staff to ensure that the contract’s documentations including terms and conditions are prepared in accordance with Company requirements”. There are no international standards for contract conditions and SSHE regulations do not govern contract formulation.
The job holder coordinates and liaises with manager and relevant Company staffs to set up, monitor, and maintain the post-contract administration system and contractor management system in order to ensure contractor’s full compliance with the contract.

Key Accountabilities:

• Participate in project team discussion to obtain strategic plan and direction to develop procurement and contract strategies.
• Coordinate with Procurement Department for bidding and negotiation process. Perform bid analysis and review required documentations including tender, requests, bid qualifications, enquiries, and commercial documents. Provide recommendation on the selection of appropriate contractors. Participate in pre-qualification exercises.
• Lead in negotiating with contractors/vendors regarding scope of work, technical specifications, estimated budget, legal and insurance terms and conditions, and job quality, etc.
• Liaise with Legal and Contract personnel in preparing and reviewing contract and agreement terms and conditions to ensure the optimum benefit in the Company interest. Prepare contractual documents and related documents including but not limited to tender packages, contract specimen, change order, amendment, minutes of meeting, etc.
• Coordinate with Legal Department in examining, evaluating claims from contractors and recommending solutions to the issues. Handle and interpret contractual documents for any contractual matters including disputes and conflicts.
• Inform project management team of any risk, exposure, or potential deviation of agreed terms and conditions.
• Set up, monitor and maintain post-contract administration system and contract management system.
• Report activities related to contractual, legal and commercial matters to appropriate parties.
• Support Procurement Department in setting up the appropriate bidder list and conduct pre-qualification evaluation of intending bidders, perform contractual review and evaluation of construction tenders.
• Coach/ guide junior level/ contracted staff so that they have proper qualifications and competencies to fulfill their job requirements. Monitor, appraise, and provide feedback to Manager regarding yearly staff performance and training & development requirements.

Professional Knowledge & Experience:

• Bachelor’s Degree in Engineering in Civil, Mechanical or related fields
• Preferably with additional degree or diploma or training in business administration, project management, or legal
• 15 years experience in construction work in E&P or related industries, preferably with offshore (deep sea) experience
• 10 years experience in position of Contract Engineer or relevant position in connection with procurement, contract administration, commercial and project management
• In-dept knowledge of a wide range of administrative and operations services
• In-depth knowledge and experience of a comprehensive range of international contracts and procurement strategies.
• Good knowledge of and experience in procurement, legal, contractual terms, commercial terms, claims/disputes, tendering, and contract management, etc.
• Ability to work in multi-disciplinary atmosphere
• Excellent analytical and negotiation skills
• Excellent project management skills and knowledge of contract management
• Good interpersonal skills
