What is IR35?



The UK government announced on 17th March 2020 that the planned off-payroll working rules reform (IR35) will be postponed for one year, in order to help businesses and individuals during the spread of COVID-19.

IR35 will now come into effect for medium and large businesses in the private sector from 6th April 2021.


New off-payroll working rules, officially known as IR35, came into force for the public sector on 6th April 2017. From 6th April 2020 they will be extended to also cover medium and large businesses in the private sector.

What is IR35?

IR35 is an Intermediaries Legislation first introduced in April 2000 to address tax avoidance by individuals working in the role of an employee through an intermediary, such as a limited company. 
Under current rules contractors are responsible for determining their employment status and paying the relevant tax and National Insurance. When the new legislation comes in, the end client will be responsible for determining the employment status of all contractors, with either the client or recruitment agency responsible for deducting the relevant tax and National Insurance contributions at source.

How do I prepare for the IR35 reform?

Ahead of the implementation of the new legislation in April, it’s important to take steps to understand your contractor workforce from an IR35 perspective. Early analysis will give you a view of your current contractor process and an indication of the IR35 status of your PSC workers, giving you the opportunity to consider any scope for optimising business processes for IR35 compliance. 

Before the reform is implemented, you will need to consider:

  1. How many contingent workers you have engaged and who are they? What are their roles?
  2. How you’re going to establish the facts of each engagement on a case-by-case basis and the processes you are going to follow to comply with the new rules.
  3. What advice, resources and tools you can use to make informed decisions about your contingent workforce.
