What is IR35?

IR35

New off-payroll working rules, officially known as IR35, came into force for the public sector on 6th April 2017. From 6th April 2020 they will be extended to also cover medium and large businesses in the private sector.
To help you prepare your business in advance of the change, Fircroft have partnered with tax experts QDOS to provide an extensive and comprehensive IR35 review service.
Ensure that you have a process in place for managing IR35 reform before April with Fircroft’s comprehensive IR35 solutions.

What is IR35?

IR35 is an Intermediaries Legislation first introduced in April 2000 to address tax avoidance by individuals working in the role of an employee through an intermediary, such as a limited company.
Under current rules contractors are responsible for determining their employment status and paying the relevant tax and National Insurance. When the new legislation comes in, the end client will be responsible for determining the employment status of all contractors, with either the client or recruitment agency responsible for deducting the relevant tax and National Insurance contributions at source.

How do I prepare for the IR35 reform?

Ahead of the implementation of the new legislation in April, it’s important to take steps to understand your contractor workforce from an IR35 perspective. Early analysis will give you a view of your current contractor process and an indication of the IR35 status of your PSC workers, giving you the opportunity to consider any scope for optimising business processes for IR35 compliance.

Before the reform is implemented, you will need to consider:

  1. How many contingent workers you have engaged and who are they? What are their roles?
  2. How you’re going to establish the facts of each engagement on a case-by-case basis and the processes you are going to follow to comply with the new rules.
  3. What advice, resources and tools you can use to make informed decisions about your contingent workforce.

Fircroft's IR35 Service

Fircroft can undertake complete project management of IR35 reform and implement any required changes that are required by your business, in advance of the new legislation. Our solution is tailored to your business and is undertaken with minimal disruption to your ongoing work.

Your contractor business process will be assessed by a senior IR35 consultant with over 10 years experience, who will provide expert advice in the form of an audit report containing recommendations to ensure your business can continue to operate successfully under IR35 rules.

Your consultant will assess your contracts and working practices and make suggestions for adapting your current business model to be IR35 compliant. Your report will also include estimated costings based on the likely percentage of workers falling inside/outside IR35, as well as a summary of contract review and working practices findings.

Fircroft can provide training through regular contractor engagement sessions and workshops, and implementation of new processes or procedures based on recommendations made during the review process. Our ongoing management service will also take care of the assessment of any additional new starters, and re-assessments of current contractors as needed.
